Terms of Service

These Terms govern your access to and use of the FoolProof platform ("FoolProof," "we," "us") — the point-of-sale, inventory, storefront, and delivery software we provide to licensed alcohol retailers. By creating an account or using the platform, you agree to these Terms.

1. Who may use FoolProof

FoolProof is offered to businesses that hold a valid license to sell alcoholic beverages in their jurisdiction. You represent that you are authorized to bind your business and that your business holds all licenses required to operate.

2. What FoolProof provides

We provide software to help you run your store: register/checkout, catalog and inventory, an online storefront, reporting, and tools that assist with alcohol-delivery compliance (age checks, delivery-eligibility rules, and quantity limits). FoolProof is a software tool — you remain the seller of record and are responsible for lawful operation of your business.

3. Your responsibilities

You are responsible for complying with all applicable alcohol-beverage laws, maintaining your licenses, verifying customer age at sale and delivery, configuring your store's rules and policies correctly, and the accuracy of your catalog, pricing, and legal/policy details. Compliance features we provide are aids, not a substitute for your own legal obligations.

4. Accounts & security

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

5. Fees

Subscription and any usage fees are as described at signup or in your order. Fees are non-refundable except where required by law. [Adjust to your pricing model.]

6. Payments

Card payments are processed by third-party payment processors. FoolProof does not store full card numbers. Your use of a processor is also subject to that processor's terms.

7. Data

Our handling of information is described in our Privacy Policy. Data you and your customers enter remains yours; you grant us the rights needed to operate the service on your behalf.

8. Acceptable use

You may not use FoolProof to break the law, sell to minors, circumvent compliance controls, disrupt the service, or infringe others' rights.

9. Disclaimers & liability

The platform is provided "as is." To the fullest extent permitted by law, FoolProof disclaims implied warranties and is not liable for indirect or consequential damages. Our aggregate liability is limited as permitted by law.

10. Termination

Either party may terminate as described in your order or these Terms. On termination you may export your data for a reasonable period.

11. Governing law & changes

These Terms are governed by the laws of the State of Alabama. We may update these Terms; material changes will be posted here, and continued use constitutes acceptance.
